Zoosh Terms of Use
Effective date: October 13, 2026
1. Who we are
Zoosh is a Mac app published by Turbo Graffix, of Los Angeles, California, USA ("we", "us"). These terms are a contract between you and us. By clicking "I agree" or using Zoosh, you accept them, along with the Zoosh Risk Disclosure and Privacy Policy. If you do not agree, do not use Zoosh.
2. What Zoosh is, and is not
Zoosh is software for viewing and trading your own brokerage account through your broker's official API. Zoosh is not a broker-dealer, not an investment adviser and not a bank. We do not hold your money or securities, execute or clear trades, or give investment, tax or legal advice, recommendations or signals. Nothing in Zoosh is an offer to buy or sell any security, or advice to open a brokerage account. Charts, chart studies, "trend" and "activity" reads and every other figure in Zoosh are information only.
3. Eligibility
You must be at least 18, able to make a binding contract, and legally able to open and use a brokerage account where you live.
4. Your license
We give you a personal, non-exclusive, non-transferable, revocable license to install and use Zoosh on Macs you own or control, for trading accounts that are yours, under these terms. What each plan includes will be stated in the app or at purchase. You may not:
- copy, sell, rent, sublicense or redistribute Zoosh;
- reverse engineer, decompile or disassemble it, except where the law allows this despite this limit;
- remove our notices, or get around a plan's limits or the lock screen.
5. Your broker account
- You need an account with a supported broker. Today that is Alpaca, for paper accounts only: pretend money. Live accounts are not supported yet. Support for Charles Schwab is planned and depends on Schwab's approval. We cannot promise it.
- You connect Zoosh with your broker's sign-in or with API keys your broker issues to you.
- Your broker's agreements govern your account. Your broker, not us, decides whether to accept, reject, fill or cancel orders; what you are approved for (margin, short selling, option levels and anything else); what fees, interest and borrow costs apply; and how it handles margin calls, forced sales, option expiration and assignment, and corporate actions.
- Zoosh is not made, endorsed or approved by any broker, and no broker is responsible for it.
- Your broker's confirmations and statements are the official record of your account. If Zoosh shows something different, your broker's record controls.
- Keep your Mac, your macOS login and your broker credentials secure. Anyone who can use your unlocked Mac with Zoosh open can place orders. The optional lock screen helps but does not replace securing your Mac.
6. Your orders are yours
Every order Zoosh sends goes to your own account, at the prices, size and settings you chose. That includes orders sent by automation you set up. You are responsible for checking each order before you send it or start a plan, and for every result, fee, tax and cost that follows.
7. Automation
Each of these runs only after you set it up and start it:
- Exits. Take-profit, stop and trailing stop levels you set. Where your broker supports it, Zoosh sends them as bracket or OCO orders that your broker holds. Where it cannot, Zoosh holds the exit itself and sends it when your level is reached.
- Expiry sale. If you still own an option on its last trading day, Zoosh sends a market order to sell it from 10:00 a.m. New York time, to try to keep it from being exercised into shares.
- Jump. You set a price range. Zoosh buys near the bottom and sells near the top, again and again, at your size, until you stop it or the price breaks your outer stop.
- Bounce. You set a price range. Zoosh buys at the bottom and sells short at the top, repeating until you stop it or the price breaks out of your outer stop range. Short selling needs a margin account and your broker's approval.
- Multiplier. Buys options in Easy mode.
- Bots. Programs you connect yourself, such as a script or an AI agent, each with a key Zoosh makes for it. A bot can read your balance, positions, its own orders and prices, and send orders for stocks and ETFs, within the limits you give it and Zoosh's own limits. In Ask first, each order waits for your yes. Bots work only on Practice and paper accounts. You choose and run each bot: it is not ours, we do not check what it does or why, and every order it sends is yours. A script can also be a file you pick for Zoosh to start for you: it runs on your Mac as you, and can reach whatever a program you start yourself can, so run only code you trust.
Limits. Exits Zoosh holds itself, the expiry sale, the repeating logic of Jump and Bounce, and every bot's orders run on your Mac. They work only while your Mac is awake, Zoosh is open and connected, and your broker's API is working. If your Mac sleeps, Zoosh quits or crashes, or the internet drops, they do not act, and they will not catch up later at the price you wanted. Orders already sent to your broker stay open there until they fill, expire or are cancelled.
Automation can also fail or surprise you. Bugs, wrong data, partial fills, rejected orders, gaps and fast markets can cause an order you did not expect, or no order when you expected one. A market order can fill far from the last price. The expiry sale can fail, for example if there is no buyer, and the option may then be exercised or expire worthless. Watch your account, and keep your broker's own app or website at hand. After you stop a plan, check your broker account for open positions and open orders.
8. Practice account
The Practice account uses simulated money and simulated prices. No real order is placed. Practice results do not reflect real fills, fees, slippage or market depth, and do not predict real results. A paper account at your broker is a separate service run by your broker under its own terms.
9. Market data, news and calendar
Quotes, bars and option chains come from your broker's data service. News headlines come from third-party news feeds. Data can be delayed, incomplete or wrong. Free feeds, such as IEX, cover only part of the market, so prices shown may differ from the full market. Market hours and holidays come from a calendar built into Zoosh and may be wrong. Do not rely on any of it alone.
10. Third-party services
Zoosh depends on services we do not control, including your broker, data and news providers, and Apple (macOS, Keychain, Touch ID and notarization). Their terms apply to your use of them. We are not responsible for their outages, errors, rejections or changes. A broker can change or end API access at any time, and Zoosh may then stop working with that broker. Apple's notarization is an automated security check, not a review or endorsement of Zoosh.
11. Plans and fees
Zoosh may offer a free tier and paid plans. The price, billing period, renewal terms and refund terms of any plan will be stated at purchase, and you will be charged only if you agree to them. Broker charges (commissions, regulatory fees, margin interest, borrow fees and data fees) are separate and are between you and your broker.
12. Changes to Zoosh
We may add, change or remove features, or stop offering Zoosh. A broker's API changes may require a new version of Zoosh, and older versions may stop working.
13. Ownership
Zoosh, its code, design, name and logos belong to us or our licensors. These terms give you no rights in them beyond the license above. Third-party components and fonts in Zoosh are used under their own licenses. Your account data is yours. If you send us feedback, we may use it without owing you anything.
14. Acceptable use
Do not use Zoosh to:
- break any law or regulation, or your broker's or a data provider's terms;
- manipulate markets, including spoofing, layering, wash trades or pump-and-dump schemes;
- trade an account you are not authorized to trade;
- overload, probe or interfere with a broker's or data provider's systems;
- copy or resell market data in breach of the provider's terms.
15. No warranty
Zoosh is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that Zoosh will be error-free or uninterrupted, that any order will be sent, filled or filled at a given price, or that any data is correct.
16. Limitation of liability
To the fullest extent the law allows:
- we are not liable for trading losses, lost profits, missed or late trades, orders sent or not sent by automation, or indirect, incidental, special, consequential or punitive damages, even if we were told they were possible;
- our total liability for all claims about Zoosh is limited to the greater of what you paid us for Zoosh in the 12 months before the claim, or $50.
Nothing in these terms limits liability for fraud, gross negligence, willful misconduct, or anything else the law does not allow to be limited. Some places do not allow some of these limits, so they may not all apply to you.
17. Indemnity
You agree to cover our reasonable costs and losses, including legal fees, from third-party claims caused by your breach of these terms, your misuse of Zoosh, or your violation of law or of someone else's rights.
18. Ending these terms
You can stop at any time by deleting Zoosh. To cut off Zoosh's access to your account, also delete or revoke its API keys or access at your broker. We may end your license if you break these terms. Sections 2, 6, 7, 13 to 17, 20 and 21 survive.
19. Changes to these terms
We may update these terms. We will post the new version with a new effective date, and show material changes in the app before they apply to you. If you keep using Zoosh after that, the new terms apply. If you do not agree, stop using Zoosh.
20. Law and courts
California law governs these terms, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts in Los Angeles County, California, and you and we consent to their jurisdiction. This does not remove consumer protections you have under the law where you live that cannot be waived by contract.
21. General
These terms, the Risk Disclosure and the Privacy Policy are the whole agreement between you and us about Zoosh. If a part is found unenforceable, the rest stays in effect. If we do not enforce a right, we have not waived it. You may not transfer these terms. We may transfer them to a successor to the Zoosh business.
